Power of Attorney/Durable Power of Attorney
A power of attorney (POA) document allows another person to act on your behalf in matters spelled out in the document. The powers authorized remain in force as long as you have the capacity to perform them, or at which time you choose to have someone else, such as a fiduciary, take care of them for you. Should you become incapacitated, the durable power of attorney will allow whomever you designate to perform the duties designated in your POA documents. Some of the powers of attorney granted in a typical POA document include:
- Paying bills
- Handling banking transactions
- Managing investments including real estate
- Overseeing completion and filing of tax returns
- Managing retirement plan transactions
By appointing a fiduciary as your designated power of attorney, you and your family can rest assured that your affairs will be attended to regardless of your interest in or ability to manage them for yourself.
Most estate plans name a family member or close friend as the successor trustee without regard for whether the responsibility might be too much of a burden for the person being appointed. In some families the appointment of one person may create unwanted conflict with other family members. By appointing a fiduciary as the trustee or successor trustee, your estate plan will be managed in accordance with the trust document, while being mindful of possible family dynamics.
